Welcome to Advisor Solar. These Terms and Conditions ("Terms") govern your use of our website and services for residential and commercial solar installations in New Jersey and Delaware. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

Advisor Solar provides solar panel installation, consultation, maintenance, and related services ("Services") in New Jersey and Delaware. All Services are subject to a separate written agreement that will specify the scope of work, pricing, timeline, and other project-specific details.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use our Services. By using our Services, you represent and warrant that you meet these requirements.

3. Quotes and Estimates

Quotes and estimates provided by Advisor Solar are valid for 30 days from the date of issue unless otherwise specified. Final pricing may be adjusted based on site assessment, permit requirements, or changes to project scope. All quotes are contingent upon site inspection, structural assessment, and utility approval.

4. Contracts and Agreements

Once you accept a quote, you will be required to sign a formal installation agreement. The installation agreement will include:

  • Detailed scope of work

  • System specifications and equipment details

  • Total project cost and payment terms

  • Timeline for completion

  • Warranty information

  • Cancellation and refund policies

  • State-specific disclosures required by New Jersey and Delaware law

The installation agreement supersedes any prior verbal or written communications and constitutes the entire agreement between you and Advisor Solar.

5. Right to Cancel (New Jersey and Delaware)

New Jersey: Under New Jersey's Home Improvement Practices regulations, you have the right to cancel your contract within three (3) business days of signing by providing written notice to Advisor Solar. This cancellation right applies to home improvement contracts exceeding $500.

Delaware: Under Delaware's Home Improvement law, you have the right to cancel your contract within three (3) business days of signing by providing written notice to Advisor Solar.

To exercise your right to cancel, you must provide written notice via certified mail, email, or hand delivery to the address listed in your installation agreement within the cancellation period.

6. Payment Terms

Deposit: A deposit is required to begin work, as specified in your installation agreement. In New Jersey, deposits are limited to one-third of the total contract price or $1,000, whichever is less, until work begins.

Progress Payments: Payments may be structured as milestones are reached (e.g., after permitting, after installation, after inspection).

Final Payment: Final payment is due upon completion and approval of the installation, unless financing is arranged.

Financing: If you choose to finance your solar system through one of our partners, you agree to the terms and conditions set forth by the financing company. Advisor Solar is not responsible for financing terms, approval, or repayment.

Late Payments: Late payments may be subject to interest charges as permitted by New Jersey and Delaware law.

7. Installation and Timeline

We will make reasonable efforts to complete your installation within the estimated timeline. However, delays may occur due to:

  • Weather conditions

  • Permit approval delays from local municipalities

  • Utility interconnection requirements from Atlantic City Electric, PSE&G, JCP&L, or Delmarva Power

  • Supply chain issues

  • Unforeseen site conditions

Advisor Solar is not liable for delays outside of our reasonable control. We will keep you informed of any significant changes to the project timeline.

8. Permits and Approvals

Advisor Solar will obtain necessary permits and approvals from local authorities in New Jersey and Delaware and coordinate with utility companies on your behalf. You agree to cooperate with us by providing access to your property, signing required documents, and providing any information needed for permitting.

You are responsible for ensuring that any homeowner association (HOA) or other governing body approvals are obtained if required. We can assist with this process but are not responsible for HOA decisions.

9. State Licensing and Registration

New Jersey: Advisor Solar maintains all required licenses and registrations under New Jersey law, including home improvement contractor registration.

Delaware: Advisor Solar complies with all Delaware contractor licensing requirements and maintains appropriate registrations.

10. Property Access

You grant Advisor Solar and our subcontractors access to your property during reasonable hours to perform site assessments, installations, inspections, and any warranty or maintenance work. You agree to provide safe and unobstructed access to the installation area.

11. System Ownership and Title

Cash Purchase: Upon full payment, you own the solar system outright.

Financed Purchase: If financed, the lender may hold a lien on the system until the loan is paid in full. Title transfers to you upon final payment.

Third-Party Ownership (if applicable): If you enter into a lease or power purchase agreement (PPA), the system remains the property of the third-party owner as specified in that separate agreement.

12. Warranties

Workmanship Warranty: Advisor Solar warrants that installation work will be free from defects in workmanship for a period of 10 years from the date of installation completion.

Equipment Warranties: Solar panels, inverters, and other equipment are covered by manufacturer warranties, typically:

  • Solar panels: 25-year power output warranty, 10-12 year product warranty

  • Inverters: 10-25 year warranty depending on manufacturer

  • Batteries (if applicable): 10 year warranty

We will provide you with all warranty documentation. Equipment warranty claims must be submitted to the manufacturer in accordance with their warranty terms.

Roof Penetration Warranty: We warrant that roof penetrations made during installation will be watertight for 10 years, subject to normal wear and roof maintenance.

Warranty Exclusions: Warranties do not cover damage caused by:

  • Acts of God, natural disasters, or extreme weather

  • Improper maintenance or modifications by others

  • Normal wear and tear

  • Damage caused by pests, animals, or vegetation

  • Failure to maintain adequate insurance

  • Coastal corrosion (for installations within 3 miles of ocean)

13. Maintenance and Monitoring

You are responsible for routine maintenance of your solar system, including keeping panels clean and clear of debris. We offer optional maintenance plans for ongoing service.

If your system includes monitoring equipment, you agree to maintain internet connectivity required for monitoring functionality. We are not responsible for monitoring failures due to internet outages or equipment failures outside our control.

14. Performance Estimates

Any energy production estimates provided are based on historical weather data, system specifications, and industry-standard modeling tools. Actual performance may vary due to weather, shading, system degradation, utility changes, and other factors. Advisor Solar does not guarantee specific energy production or cost savings.

15. Interconnection and Net Metering

We will coordinate with your utility company (Atlantic City Electric, PSE&G, JCP&L, or Delmarva Power) to establish interconnection and net metering.

New Jersey: Net metering policies are governed by New Jersey's Board of Public Utilities regulations. Solar Renewable Energy Credits (SRECs) may provide additional value, but market prices fluctuate.

Delaware: Delaware's net metering program allows you to receive credit for excess generation. Policies are subject to change by Delaware's Public Service Commission.

Advisor Solar is not responsible for changes to net metering policies, utility rates, or SREC values.

16. Incentives and Tax Credits

You may be eligible for federal tax credits, state incentives, and local rebates. We can provide general information about available incentives, but you should consult with a tax professional regarding your specific tax situation. Advisor Solar is not responsible for changes to incentive programs or your eligibility for tax benefits.

New Jersey: Various state incentives may be available through the New Jersey Clean Energy Program.

Delaware: Delaware offers various renewable energy incentives that may apply to your project.

17. Cancellation After Right to Cancel Period

If you cancel after the three-day right to cancel period and after work has begun, you may be responsible for:

  • Costs incurred up to the cancellation date

  • Materials ordered specifically for your project

  • Permits obtained

  • Labor performed

  • A cancellation fee as specified in your installation agreement

18. Changes to Project Scope

Any changes to the project scope, system size, or equipment specifications must be approved in writing by both parties and may result in price adjustments and timeline changes.

19. Limitation of Liability

To the maximum extent permitted by New Jersey and Delaware law, Advisor Solar's total liability for any claims arising from our Services shall not exceed the total amount you paid for the Services. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost savings, or business interruption.

20. Indemnification

You agree to indemnify and hold harmless Advisor Solar, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your breach of these Terms

  • Your misuse of the Services

  • Your violation of any law or regulation

  • Third-party claims related to your property or actions

21. Insurance

Advisor Solar maintains general liability insurance and workers' compensation insurance as required by New Jersey and Delaware law. You are responsible for maintaining adequate homeowner's insurance covering your property and solar system. We recommend notifying your insurance carrier about the solar installation.

22. Transfer of Service

If you sell your property before the solar system is installed or paid in full, you must notify us immediately. Transfer of the installation agreement to a new owner requires our written consent and may be subject to fees. The solar system may increase your property value and should be disclosed to potential buyers.

23. Dispute Resolution

Informal Resolution: If a dispute arises, we encourage you to contact us first to seek an informal resolution.

Mediation: Before pursuing arbitration or litigation, both parties agree to attempt mediation in good faith.

Arbitration: Any disputes that cannot be resolved through informal resolution or mediation shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New Jersey or Delaware, depending on where your property is located. You and Advisor Solar each waive the right to a jury trial.

Class Action Waiver: You agree that disputes will be resolved on an individual basis and waive the right to participate in class actions or class arbitrations, except where prohibited by law.

Small Claims Court: Either party may bring an action in small claims court instead of arbitration if the claim qualifies.

New Jersey Consumer Rights: Nothing in this arbitration clause waives your rights under New Jersey's Consumer Fraud Act or other applicable consumer protection laws.

24. Governing Law

For installations in New Jersey, these Terms are governed by the laws of the State of New Jersey. For installations in Delaware, these Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

25. Compliance with State and Local Laws

Advisor Solar complies with all applicable New Jersey and Delaware laws, including:

  • New Jersey Home Improvement Practices Act

  • Delaware Home Improvement law

  • State electrical codes

  • Local building codes and zoning ordinances

  • Utility interconnection requirements

26. Severability

If any provision of these Terms is found to be unenforceable or invalid under New Jersey or Delaware law, the remaining provisions shall remain in full force and effect.

27. Entire Agreement

These Terms, together with your installation agreement and any other written agreements, constitute the entire agreement between you and Advisor Solar regarding the Services.

28. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms.
